Abstract


Civil suit collateral to criminal proceedings as an important system in the criminal lawsuit of our country, set up the aim is to protect the state, the collective and the legal property rights and interests of citizens, in criminal lawsuit settlements for criminal behavior caused by the compensation of material damage problem. Its feature is civil litigation and criminal litigation, simplify the procedure, improve the trial efficiency, saving judicial resources. In recent years, our country has raised questions about the incidental civil action system. Research system of civil suit collateral to criminal proceedings, solve problems, to achieve the purpose of setting up the system is of great significance. Through reviewing the history of the system of civil suit collateral to criminal proceedings, analyzes the present situation of the system, proved that our country's system of civil suit collateral to criminal proceedings should be as an important system of protection of the victim to perfect them. The applicable law and trial procedure of concrete should be further refined. Believe that through joint efforts from all walks of life, our country criminal incidental civil lawsuit system will be gradually perfect.
