Abstract


Civil retrial reason is the parties to a civil judgment comes into effect after enter the retrial, the key is the people's court of the effect on the stability of the referee and was sentenced to force, to ensure that valid judgement are not easy to overturn a threshold set. The role of the civil retrial reason is to start the retrial procedure, at the same time in the party seeking relief right on the maximum guarantee effective judgment of res judicata. To give full play to the role, setting the rational civil retrial reason is particularly important. Therefore, in-depth study of civil retrial reason, analysis the reasons of the existence of problems, and make reasonable argument, puts forward some countermeasures for perfecting and comprehensive amendments to our country civil procedure law, promote the reform of civil retrial system and coordination of civil retrial procedure has important theoretical and practical significance. This article from the theoretical level such as the basic concept of civil retrial reason, draw lessons from the beneficial experience of foreign legislation, on the basis of based on the situation of our country, to our country civil retrial reason guiding thought and reason, the improvement of the design are proposed.
