Abstract


As China enters the environment risk society , public participation in environmental protection role more and more attention , and as a key environmental risk regulation in the environmental impact assessment of public participation can not be ignored . Environmental rights theory, the theory of democratic theory and governance of public participation in environmental impact assessment system provides a theoretical basis . Public participation in environmental impact assessment system is mainly the pursuit of value in order to achieve environmental justice, it is for improving the democratic decision-making , science and acceptability decision process supervision , coordination conflicts of interest , to raise public environmental awareness and awareness of their rights and so has positive role. Through analysis and discussion of public participation in environmental impact assessment system the legislative process and the Beijing \main provisions are too vague ; narrow target range of public participation ; public participation phase of late ; public participation requirement is unreasonable ; public participation in the legal effect is not clear ; lack of adequate environmental information support ; public participation in the absence of judicial guarantees and other deficiencies. Then , the article focus from participating subjects involved objects involvement stage , participation and other aspects discussed the United States, Japan and Taiwan of China public participation in environmental impact assessment system , and with our existing system compared based on this summary of these countries and regions worth our reference legislation and practical experience. Finally, our public participation in environmental impact assessment system deficiencies , the article based on the reality of our country , learn from the advanced experience of public participation in environmental impact assessment from the contents of the program , environmental information disclosure and judicial protection perspective by improving the public participation in environmental impact assessment of system concept.
