Abstract


Composition of tort liability in the environment , whether the illegality element can become constituent elements of Environmental Liability has come is a controversial issue. Held a negative view of the scholars believe that the Environmental Liability constitute only injurious acts harmful consequences and behavior and a causal relationship between the results can be. ' Another part of the scholars advocate illegality can not be discarded elements , as opposed to a negative view of scholars illegality element should be used as the elements constituting Environmental Liability . Whether to take \As society continues to develop , people's behavior is constantly adjustments and changes . Illegality legal requirements to help people adjust to changing behavior, acts of human freedom delineated space, while a large number of borderline cases , reflecting the charm of its adaptation to changes , the basis for judges settle a lawsuit . I believe in the element of unlawful infringement environment should not be discarded, either from the elements of unlawful sexual function , or finds infringement , unlawful sexual element has its own independent existence.
