Abstract


In recent years, with the rapid development of e-commerce, electronic payment in the payments and settlement system has gradually become an important method of payment. The security of electronic payment is the core issue of client money. In spite of the progress of science and technology can reduce cash flow of the technical risk, but when safety risk cannot be cut by the loss of the distribution system becomes especially important. Electronic payment based on the transaction object can be divided into mass consumers and business firms or financial institutions two kinds big, due to the payment settlement between the businessmen pursue fast and safety, and the payment settlement between consumers and businessman is particularly emphasized the safe trading and the special protection for consumers, so the law will be because of the particularity of trading party position, make different arrangement. Based on this, our country should according to the two types of trading by roots of different value orientation, the commercial capital and microfinance payment settlement model using two different kinds of specification, design different private law responsibility imputation basis.
