Abstract


With the rapid development of the Internet in China , accompanied by Internet legal issues become increasingly prominent , the popularity of the Internet and the development of a network of publications constantly updated publications prevalent in today's network era , the proliferation of illegal Internet publications serious , very common phenomenon applies to illegal Internet publications for profit related cases emerging in this regard , but our legislative, judicial missing , there is no explicit charges can be profit-making behavior into illegal Internet publications . This paper analyzes the case is under such a background , Dong Jie , Chen Chu case the defendant as a result of the use of illegal Internet software for profit behavior as the crime of illegal business , sentenced to six years imprisonment and confiscation of all its business income. This has caused widespread concern in the community . This article describes the conduct of the case , finishing the case through the legal relationship , which leads to the focus Dong Jie , Chen beads controversial use illegal behavior case of Internet publication for profit : a case using the profit-making behavior of the legal nature of the illegal Internet publications ; two , this behavior applies in the present case, the legal basis of the illegal business convicted and punished .
