Abstract


Of folklore as an important non-material cultural heritage , with the development of science and technology , and its intrinsic value more and more attention, and will become one of the international community increasingly important strategic resource . Although the subject in the 1950s, African countries have been proposed to protect the project , due to the international status of the poor, developed and developing countries on the protection of folklore very different . The case of infringement of folklore uncommon in real life , the protection of folklore is the development trend . This paper attempts to Barcarolle \\, as discussed further below framed range . Followed from an economic perspective , the cultural perspective , the perspective of jurisprudence three perspectives discusses the legitimacy of civil copyright protection of literary and artistic works , and legislative practice of folklore of the the extraterritorial Convention / domestic law to reveal to our country Finally, on the road of our civil system of copyright protection of literary and artistic works - special copyright , and discussed the subject of rights , the rights of the content , duration of protection , tort and legal remedies .
