Abstract


Foundation development today, different countries of the model, there are differences between the requirements of the Foundation concept. International Foundation Guide Foundation formed a more authoritative concept: \, religious and other social welfare undertakings. \planning the organization of the management of the Board of Directors, the founder of the purpose is to support or aid educational, social, charitable, religious or other activities to serve the public welfare, the main way is through the sponsorship of other non-profit agencies from all walks of life to the Foundation concept not yet formed a unified view, but without exception, have followed the historical mission of the Foundation for social welfare. Foundation as an important representative of the non-governmental organizations, one whose existence itself is a highly functional color it public career as a starting point for their own behavior, the charitable purpose as their highest code of conduct, to protect the livelihood of the people as their core mission. The correct operation of the Foundation really around from the people, the benefit of the people of the mode, play an active role to maintain the role of the social order. The paper is divided into Introduction, body, conclusion of three parts, in which the body part of four chapters: The first chapter is the legal concept of the Foundation's analysis and appraisal. First, the basic connotation of the concept of the Foundation analysis, determined the basic characteristics of the foundations of the organization itself. Secondly, both foreign and domestic describes the classification of the Foundation organization, and analysis of China's Foundation special classification. Finally, to explore the social function of the Foundation, summarizes the contribution of the Foundation for China's social development. The second chapter is the analysis and appraisal of the status quo of China's legal system of the Foundation. The author through a review of the legislative history of China's Foundation and the status quo, find out the legal gaps and loopholes in the running of the Foundation, and the Foundation organization's own institutional defects caused due to the lack of law. Analysis of its underlying causes and proposed initial solution proposals. The third chapter is a demonstration of our foundations that exist within the legal relationship. Dismantling the basic elements of the legal relationship of the Foundation, and by a large number of text argument Foundation ownership of the property attributable to draw the conclusions of the Foundation within the main body are not completely the Foundation property ownership. Finally, to analyze the rights and obligations of the Foundation the main, to pave the way to make the discussion below. The author by the rights and obligations of the Foundation within institutions start looking for problems, draw governance recommendations of the Council and the Board of Supervisors. Second, the importance of external oversight by the Foundation demonstrated the need to establish external supervision system and recommendations for improvement from a legal point of view to strengthening external oversight of the Foundation.
