Abstract


In 2009,“Food Safety Law”has stated clearly the deserved function and position of the government, food enterprise, the-third-department like food trade associations. But the law has not told us how to implement their function and position. Therefore, the major issue being faced by the community of scholars is how to establish an effective and practical Food Safety Co-regulation mechanism. So in this article, according to building up the overall framework of the Food Safety Co-regulation on distribution of power, operating mechanisms and the mechanism of supervising and restricting, we will try to construct Food Safety Co-regulation mechanism which conforms to china’s national conditions, by international comparison research and empirical research.In this article, the author got the conclusions as follows: 1) On the distribution of power of Co-regulation, the standards of distribution of power is that the government only plays its role in the food safety regulatory area where the market and the-third-section can not solve the problems. Speaking concretely, the main duties of the government are to establish regulation system, issue laws and regulations and carry out the laws and regulations, and the illegal acts on Food Safety should be also punished by the government. The third-section can undertake some concrete specific monitoring work, such as regulating its members, announcing food safety information, checking out food safety and resolving disputes among its members. The food enterprise should build up its self-discipline systems, including constructing HACCP system and food traceability system, to ensure food security from the source. On government regulators, the government should definite responsibilities among horizontal functional departments and vertical departments.2)On operating mechanisms of Co-regulation, first, definite the choice criterion of the-third-section, that is complete organized management mechanisms and operation mechanism, multiple source of funds and sound financial management system and the higher social identification; And choose the best cooperation method. The food enterprise should try its best to improve the self-discipline systems. At the same time, we should contribute to establishment of social supervision system, including supervision from the media and consumers.3) On the mechanism of supervising and restricting of Co-regulation, we should have a clear understanding of the problem which is maybe caused by Co-regulation, and construct a scientific and effective the mechanism for supervising and restricting to achieve the regulatory goals. For the-third-department and food enterprises, we must strengthen government monitoring, improve social supervision and internal supervision mechanisms. For government regulators, we should improve judicial monitoring mechanisms and the executive accountability system, and built up personnel supervision mechanism.
