Abstract


To guarantee the country’s political, economic, and military security, oil reserve legal system must be further improved. At present, the oil reserve law of our country is not very complete, has many deficiencies, the complete petroleum reserve legal framework has not formed. Problem is that existing laws and regulations do not meet with the national reserve strategy, in order to ensure the development of oil reserve, China needs to further improve the legal. Formation of petroleum reserve system in Western developed countries, all legislate first. China should also be in accordance with international practice, speed up the formulation of laws on oil reserves, in order to let the petroleum storage system develop along the standardization, legal direction.This text tries proceeding from oil reserve intension and petroleum storage system, analyze in depth the oil reserve question in terms of basic theory, compare different types of oil reserve modes; propose that it is necessary to adjust the oil reserve by legal means; explain legal system and policy idea of western developed national petroleum reserve such as Japan, U.S.A., France sequentially, compare and analyze legislative characteristic and practical experience of various countries, combine the actual conditions of our country, absorbing and drawing lessons from legislative thinking and feasible scheme of other countries constantly, improve the oil reserve legal system of our country gradually; through analyzing the current legislation situation of the oil reserve of our country and the necessity of accelerating the legal construction, explore questions such as the basic principle and basic content of the oil reserve law, etc, propose the basic frame of the oil reserve legal system:regard "Energy Basic Law" as the core, commence centering on the oil reserve act and the oil security law, make the related rules and regulations at the same time, let the special law cooperate with the auxiliary law each other, form the oil reserve legal system suitable for national conditions of our country.
