Abstract


Animal welfare legislation in China has just started, but in western countries for hundreds of years. How to draw lessons from foreign advanced legislation experience, on the basis of conforms to China's reality of animal welfare law is developed in this paper to solve the problem. Full-text consists of four parts: first, the objects in the application of animal welfare law, this paper expounds the thought origin of animal welfare and animal welfare legislation origin and west development process. Secondly, from two aspects of the moral status and legal status of animals, animals have worthy of our respect for the intrinsic value is expounded, and the only object is the object of legal relation and protection, so as to seek legal basis for animal welfare legislation. Again, this paper introduces the present situation and problems on protection of animal welfare in China. Finally, through the analysis of the necessity and feasibility of animal welfare legislation in our country, puts forward the construction of animal welfare law of our country.
