Abstract


The national "11th Five-Year Plan" put forward a important system of regional development strategy,"the principal function areas". It is a major innovation of china’s regional economic theory and practice,and it will be long-term impact on our overall regional economic and social development, especially for China’s existing laws and even for environmental and resource protection laws. Based on this, from the perspective of the environmental law in this paper, the principal functional areas of management problems are discussed, by using various researching methods, such as comparative analysis, comprehensive analysis, empirical analysis and documentation, from the principal functional areas related to the concept, theory, environmental policy start, Combined with its status of environmental law, on the principal functional areas and the analysis of regional environmental issues, fully learning from foreign spatial planning experiences, and improving the environmental legal system of it in order to abide the Law, to better promote the overall coordination of regional development and the implementation of the strategy.The principal functional areas’implementation needed to laws to protect. The theoretical significances of this study is how to learn from foreign theory and practice of spatial planning outcomes, building the legal system of environmental management of the principal functional areas, modifying and improving the existing environmental laws to achieve a high degree of fit for it. It thus has practical significance that it can further relieve the increasingly acute conflicts of regional resources and environmental issues, promote regional coordination and sustainable development, reduce regional disparities and optimize the regional environmental management system.By researching on the principal function areas planning in china and based on summary of the experience of foreign countries, features on spatial development plan, the paper discuss the improvement of environmental law with the main line of the principal function areas, The text include the following four parts:The first part analyzes the environmental basic issues of the principal function areas from the theoretical and policy-oriented aspects. Firstly, the theoretical aspects include through comparing related concepts to analyze the content of the principal function areas, researching the theoretical basis of environmental management and clear criteria for the classification of it. Secondly, the environmental policy of four principal functional areas are described. Described by this section is to provide theoretical support for the following studies.The second part analyzes the situation of the environmental law of the principal function areas. In the first place, China’s current regional environmental problems and the management status are analyzed. Then, followed by combing through the principal functional areas, natural resources law and pollution control law, the status of environmental legislation of the principal function areas are summarized.The third part mainly discusses the experience of developed countries spatial planning and the enlightenment. In this part, the experiences of space planning of Germany, the Netherlands, the European Union, Japan, the United States and are studied and the characteristics of various countries space planning are summarized. On the basis of this, it brings some enlightenments on foreign space planning to the principal functional areas of environmental management for china.The fourth part mainly discusses the ideas of improving the environmental legal system of the principal functional areas. In this section, the paper by combining with the legislation of the current status of environmental law, learning from the experience of spatial planning in developed countries, the improvement recommendations of the environmental legal system of the principal function areas are made. Finally, the paper concludes that in order to promote the system of the principal functional areas in harmony with the environmental legal system, the construction of the environmental legal system must fully absorb the experience of spatial planning in developed countries, improve and perfect the environmental laws and regulations, establish the administrative systems and mechanisms of inter-regional coordinated development, promote citizens’broad participation of the principal functional areas planning’s preparation and implementation, strengthen environmental responsibilities of local governments Etc., and to the purpose of providing environmental Legal protection for the principal functional areas construction.
