Abstract


Currently, funds and expenditures of China’s procuratorates at different levels are all shouldered by the local governments. Fiscal budget allocation will provide the major part, supplemented by fiscal allowance and fines refund. This system has become an important factor restricting the development of procuratorial work, featured by insufficient funds of basic level organs, big gap of the guarantee level among different regions and lack of (?)ndards in law enforcement.In recent years, the central and provincial grassroots financial year increased transfer payments to the prosecution, the local Party committees and governments at all levels of law enforcement authorities try to improve conditions for office and equipment for prosecutors handling cases according to the normal operation and provide a strong funding protection. However, due to the imbalance of regional economic development, grassroots financial generally weak, the State Council on the protection of law enforcement authorities, "eat imperial grain" payments completely "decoupled" from the requirements of law enforcement authorities at the grassroots level in general difficult to implement. To ensure funding for the prosecution at all levels rely entirely on the level of local government, less developed or underdeveloped areas to ensure funding is still difficult prosecution.In theoretical circles, studies are mainly carried out on judicial funds guarantee. Specific discussions on reform and improvement of the fund guarantee system of procuratorates are hardly found. This thesis will have a review of the evolution of China’s procuratorial fund guarantee system, analyze the disadvantages of the current system and draw a comparison of the domestic and foreign ones. Based on these, this thesis will propose a tentative reform to achieve a three-level guarantee system of procuratorial fund through coordinating the central, provincial and local finance.
