Abstract


The patient informed consent originated in the early 18th century , developed in the early 20th century, and in 1981 by the World Medical Assembly Declaration on the Rights of the patient officially confirmed . The national judicial practice constantly people's attention and get the recognition and protection of the national legislature , due to specific historical circumstances and the special conditions in China compared to other countries , for the protection of the patient 's right to informed consent start late, the protection of this right and therefore inadequate. This paper attempts to make a summary and analysis of the system of China 's relevant laws and regulations with the informed consent of patients , analysis of the patients informed consent protection advantages and disadvantages , and then put forward some suggestions and measures . In addition to the introduction and conclusion , is divided into four major sections. The first part is the doctor-patient relationship , the basic problems of the informed consent of patients . First and foremost from the micro concrete analysis of the meaning of the informed consent of patients , as well as some of the theories associated with this . Secondly macro describes the origin and historical evolution of the informed consent of patients . The right to informed consent in patients with specific analysis of the second part of the doctor-patient relationship . This section is informed consent from the patient's right to property , the main , the specific content of the exercise , the responsibility of the constituent elements and the main responsibility for five angles , to clarify the legal nature of the right to informed consent in patients . The third part is the degree of protection at home and abroad informed consent of patients and the status quo . The United States, Germany , Japan, Taiwan, China and the protection status of the informed consent of patients , these three countries and China's Taiwan region is a typical representative of the common law , civil law countries . This section mainly through the description of the protection of foreign informed consent of patients and the foreign protection status of protection like to make the necessary contrast , and ultimately come to China can learn from things , but also for the last part of laying the groundwork . The fourth part is to improve the protection of our informed consent of patients . The fourth part is some countermeasures for the third part of the lack of protection of the informed consent of patients .
