Abstract


International Factoring is a business of financial innovation which is a set of billing, finance, management of finance and guarantee of venture.In the trade settlement of Europe and the United States, International Factoring which has basically replaced the traditional method of collection and payment of the purchase price occupies an important position. But in China factoring developed slowly. Therefore researching the legal counter-measures for preventing the risk of international factoring is one of foremost conditions to carry out the operations successfully.Apart from the preface and the conclusion, this thesis can be divided into four chapters.ChapterⅠ, the summary of the international factoring .The author has a brief description of the international factoring,the generation and development of international factoring, the international factoring business and the type of procedure. and also analyse the characteristics of the law of international factoring.ChapterⅡ, the legal relationship between the parties of International Factoring.Analysing the legal relationship among the major import and export factoring and import and exporters from the example about the dual mode of international factoring.ChapterⅢ, the status quo of international factoring in China’s commercial banks.By a way of comparative analysis,the author states the gap of internationa factoring between our country and other countries and describes the current and comprehensive legal environment of our country and the far-reaching significance about carrying out operations of international factoring from the volume of the international trade.ChapterⅣ, the risks and preventive measures for the international factoring.The author combine the practices of business and mainly analyzses the various risk factors and preventive measuresthe the commercial banks as a factor in the factoring business may encounter.Trough the study and solving the legal issues about our country in factoring business,it may promote the development of the growth of new varieties international factoring vigorously and improve the competitiveness of China’s banking industry. Thus, it may promote china commercial banks and the development of enterprises effectively.
