Abstract


This article is composed of three parts by the introduction , body and conclusion . The preamble describes the necessity and urgency of the protection of international law of transboundary rivers , point to understand the purpose of this paper by reviewing the historical development of international law to protect cross-border rivers , the discourse of international law of transboundary river protection system , to indicate that the protection system of international law of transboundary rivers deficiencies and trends. The first chapter is an overview of international law to protect cross-border rivers . This chapter is divided into three : the first through the analysis of international law on the river classification , given the definition of cross-border rivers , and analysis ; section II, a simple clarification of a few basic questions of the protection of international law on transboundary rivers , in order to behind the discourse ; Section III a brief review of the historical development of the protection of international law on transboundary rivers , and pointed out the characteristics of each stage . The second chapter described the protection system of international law of transboundary rivers . This chapter is divided into four sections: The first section discusses the basic principles of international law to protect cross-border rivers , the basic principles of meaning , and as a basis for the argument to the Treaty , the relevant legal documents and judicial practice ; Section II from the legal status basic functions , characteristics and classification discussed the organization of cross-border rivers protected by international law ; Section III on the basis of the basic theory of international law , combined with the latest treaty in the field of State responsibility , and discusses the cross-border rivers, the field of international law to protect the State under what circumstances responsibility ; Section IV describes the important treaty on cross-border rivers dispute settlement provisions , and on this basis that the dispute settlement system for cross-border river areas of international law in general there is no real breakthroughs and innovations . The third chapter is a discourse on the development trend of international law to protect the system of cross-border rivers . This chapter is divided into four main analysis of the international law of transboundary rivers, the protection system is insufficient and that the development trend of the international law of transboundary river protection system . Conclusion that the protection system of international law of transboundary rivers has been made significant progress , there are still many deficiencies , the performance of many developing trends . Transboundary river protection system of international law will continue to enrich , develop and improve , it will play a greater role in the adjustment of the field of protection in cross-border rivers .
