Abstract


Juvenile delinquency is a common problem in modern society , China is no exception . In order to avoid minors against cross-infection and healthy return to society , we try minor criminal cases , application of criminal reconciliation . Criminal reconciliation can reduce juvenile delinquency , which is conducive to the realization of a harmonious society . We should conform to the world of criminal justice reform wave , learn the extraterritorial effective experiences , combined with today's judicial practice , initially to build and perfect fit for China minors criminal reconciliation . This paper can be divided into the following sections: The first part of criminal reconciliation concept definition and with compounding , plea bargaining , mediation , restorative justice concept to distinguish between , and then discusses the value and shortcomings of the criminal reconciliation . The second part discusses the theoretical basis of the criminal reconciliation and cultural foundation that the theoretical cornerstone of Western criminal reconciliation \These three theories are not the basis of the Chinese Criminal reconciliation , our own in its own unique theoretical foundation and cultural foundation . The third part discusses the scope of application of criminal reconciliation . Two angles from the applicable procedures and scope of the case as a pilot to demonstrate criminal settlement first in the case of minors , when conditions are ripe and then gradually extended to other types of cases . The fourth section discusses the requirements and the practice of our legislation and policies reflect the philosophy of criminal reconciliation . The fifth section describes the United Nations \Part VI discusses the application of criminal reconciliation in juvenile delinquency cases necessity . Mainly from China 's reality and judicial practice combined with knowledge of education psychology were discussed. Part VII is a preliminary idea of the conditions and procedures applicable in cases of juvenile delinquency , criminal reconciliation .
