Abstract


Property investigation in civil enforcement procedure is the key step to realize the function of civil enforcement procedure.As to the current situation of enforcement practice in our country,many obligees’ rights can not be realized,for the reason that the property clue of the obligor can not be found out.This essay sets out from the concept of property investigation system,the theories about this concept and the significance of the system,compares and analyzes the system in other countries and areas.And then,on the basis of discussing the current situation of property investigation system in civil enforcement procedure,the writer puts forward specific ideas of how to perfect property investigation system in civil enforcement procedure.The essay is consisted of preface,content and conclusion.And the content is divided into four parts.The first part is the general introduction of the property investigation system in civil enforcement procedure.Firstly,this part introduces the concept of the system.Secondly,it discusses the main theories about the system.At last,it analyzes the significance of the system.The second part is the comparison and study on the property investigation system in other countries and areas.After introducing the property investigation system in France,Germany,England,America and Taiwan in our country,this part discusses and compares the system in these countries and areas.The third part is the discussion of the current situation and problems of the property investigation system in our country.Combining with the laws and regulations of our country,this part summarizes the main methods of property investigation.Then,the writer points out the main problems of the system.The fourth part is the suggestion of perfecting the property investigation system.As to the current situation of our country,the writer suggests that our country should perfect property investigation system in civil enforcement procedure in three aspects,including legislation,method and safeguard.
