Abstract


Social security,for all citizens of the country,including all kinds of economic well-being measures implemented according to the law,is the basic security system to safeguard social equity and promote the well-being of the people,to achieve the target of all people share the fruits of development.Only owning a sound and complete social security system,a country can be said a harmonious development country.To achieve the security target by legislation is the universal measure for all national social security system in the world.Through the arrangement of the social security system to achieve the parallel development of both national economy and national well-being is the country and the government’s duty to protect the people’s livelihood.As an important part of the foundation and core of social security system,China’s social security fund grow rapidly these years,but the Fund’s losses caused by mismanagement of funds and weak in monitoring concerns so many people,the current government also pay more and more attention to this problem and improve the related legal system gradually.The first chapter in this article starting from the historical development and international comparisons of social security fund monitoring legal system and of international comparisons,vertically reviewed the historical development of China’s social security system and corresponding supervising legal system,cross wisely make a comparative analysis on internationally characterized legal system for monitoring the Fund.On this basis,the second chapter issues a detailed analysis on the current status and problems of China’s social security fund operations and monitoring.ChapterⅢof the paper establishes my own regulatory framework and legal system of social security fund supervision by comparative study of foreign countries’ social security fund supervision legal systems.Through above-mentioned discussion,I attempt to build a social security fund supervision framework of the legal system.In this framework,the regulator can take into account the principle of equity and efficiency,combined with the specific situation in current stage of China’s social security system,on the basis of market economy self-adjust,take reasonable government control,establish a legal system of social security fund supervision and study the reliability of the legal system from a scientific prospective.
