As the deepening of Chinese higher education reformation,to make reasonable of the relationship between universities and the Government,and to find out the inherent laws and development trends in the Complex interaction of them become more and more important.This article give three types of the relationship between universities and the Government from the education systems of American,French,English,Germany and Japanese.we analysis the Strict historical,Status quo and Contradictions of the relationship between universities and the Government of China,and then give four important problems,we analysis the relationship of Related-benefits,Principal-agent, Administrative-law and Harmonious-interaction between universities and the Government from the economics,governance,Jurisprudence and Sociology With Sub-sections.Finely we give the Countermeasures of the harmonious development between universities and the Government,and give the prospect of it.we believe that higher education reformation must Change ideas,go out Plight,find out the System of the right checks and balances with the decentralization,make reasonable of the relationship of related-benefits and Principal-agent.And the Government should strengthen the support and supervision to universities with the Means of legislative,economic,administration and information.In areas of legal and society,we should play initiative of universities,realize academic freedom and university autonomy maximum,realize mutually-beneficial,clear-duty, unity and harmony between universities and the Government.
