Abstract


In order to eliminate the obstacles set up by the States on trade in services , and promote the healthy development of international trade in services , developing and developed countries eventually reach a compromise , the conclusion of the General Agreement of Trade in Services ( GATS ) . China in the process of accession to the WTO , after careful negotiations to finalize the trade in services schedules of specific commitments . Travel services , relates only to the hotel industry and the travel industry . In this paper, the General Agreement of Trade in Services ( GATS ) and travel services market access , national treatment commitments made by addendum or memorandum of understanding as a starting point , a comprehensive analysis of the current legal environment of China's tourism industry and tourism legislation the problem with reference to the laws of the United States and Japan and other developed countries and advanced experience , put forward to improve our tourism legislation is necessary to accelerate the formulation of the Basic law of the travel . China's accession to the WTO , it means the organization by normative legal documents and international conventions binding on China , China's tourism legislation should behave as the GATS principle of non-discrimination , the principle of trade liberalization and the principle of transparency , as well as trade in tourism services in China 's WTO commitments , in the form of laws or norms in domestic law to confirm , or modify old , aging provisions of the law , having a Legislative reunification . Since joining the WTO , China 's commitment for the performance of tourism services legal measures based on the current tourism legislation still exist . For example, the serious lack of law , the lack of a tourist Basic Law to unify the regulations behind the demands of the times , are yet to be resolved . In contrast , more mature tourism in the United States and Japan and other developed countries , tourism legislation more complete analysis benefit from the advanced mode legislation and legislative content , should be made to improve China's tourism legislation , it is necessary to accelerate the development of a tourism Constitution \So far , China 's tourism-related legislation greatly behind the need for further development of tourism for China's tourism industry to build a solid specification theoretical basis , making the results of our study have a greater value is an urgent need in the course of the study to solve the problem , this paper attempts to do a study in this regard .
