Abstract


After revising the criminal law has made the corresponding limits in general provisions to crimes committed by a unit, specific provisions has enumerated behaviors of crimes committed by a unit in detail. Because the time which the corporate crime had been introduced by our country criminal is brevity, its items is too simplified in general provisions and its capacity in general provisions is not enough, therefore it caused that the judicial officials have different understanding to constitution of crimes committed by a unit, moreover, different judicial region on recognizing in may obtain a disparate result. On the basis of the fundamental research of crimes committed by a unit in criminal law and the judicature experience, the article starts with recognizing the subject of crimes committed by a unit, give emphasis to analyze crimes committed by a unit and the corporate crime, crimes committed by a units and the natural person crime, as well as some questions that were needed to be solved urgently on crimes committed by a unit, the author expects having some help to recognize crimes committed by a unit in the judicial practice. Furthermore, the article also probes into punishment application of crimes committed by a unit, and combining some questions which may meet in judicial practice, the article launches the further ponder suitably to punishment application of crimes committed by a unit.
