Abstract

Crime of embezzlement is the crime of traditional type of violating property rights. The emergence and development of the crime of embezzlement is relevant to commodity economic development and the extent to dominator paying attention to it. The nature character of the crime of embezzlement is that non-property owners illegal possess property owners’belongings in whichever historical forms’society is. As the crime of embezzlement in crime law belongs to new criminal conduct, the theory scholars and the actual practice scholars researching it has been in the beginning stage. There are great disputations in asserting the crime of embezzlement. Therefore, this theme is to discuss and research some issues deeply so as to drawing author’conclusions under the guidance of dialectical materialism and historical materialism. The author wants to perfect criminal legislation and provides comparative reasonable solution ideas for instructing criminal jurisdiction.
