Abstract


The foreign direct investment has become the new tendency. As the economic globalization, the capital international flowing plays the vital role to the investor and the host country. But the parties of the investment often are often in“gambling”condition, if they can not get well, the bilateral relations will break up from the cooperation. Through one typical case“Wahaha——Danone”trademark rights dispute, the article reflect the insufficiency trademark rights protection in the foreign direct investment process in our country, analyze the reason of trademark loss in the foreign direct investment process. Based on the above analysis, point out that we should be cautious when sign the foreign direct investment agreement and makes good use of the existing law to protect the trademark rights .This article altogether divides into four parts:The first chapter is the introduction. Elaborate that the article research background and the significance, namely under the foreign direct investment prosperous background, how do reduce the trademark rights legal dispute. Summary the domestic and foreign research result in foreign direct investment trademark rights protection.The second chapter is the trademark rights protection in the foreign direct investment. Based on the explanation of the elementary theory and the conception, discuss the“Wahaha——Danone”trademark rights dispute, point out when we face the challenge in the trademark rights protection s, we can not merely lift“the national brand”the flag, the key is to take seriously to the trademark rights. Currently, the existent problems in the trademark rights protection in the foreign direct investment are: Firstly, people do not attach importance to the trademark rights protection when we sign the articles related the trademark, Secondly, because lack the standard intellectual property rights exchange market and without a scientific trademark appraisal standard.The third chapter is the multiple dispute resolution mechanism in the trademark rights dispute in the foreign direct investment. When face the trademark disputes, we should take positive rational attitude and use consultation, mediation, arbitration, lawsuit solve it to maintain good relationship.The fourth chapter is trademark rights protection strategy in the foreign direct investment. Through learning the brand protection experience from US, Germany, South Korea, put forward some suggestions on trademark rights protection in the foreign direct investment from the enterprise and the national aspect.
