Abstract


In the electronic process of finance, the competition between commercial banks has developed into the battle of high-quality customers and financial products. And the sophisticated financial products help banks to develop business and wide market as well. Citibank, the representative of overseas commercial banks, has submitted a series patent of business methods to Chinese Intellectual Property Bureau, with an intention to set up a patent wall in front of China’s Commercial Banks. However, China’s commercial banks have not attached enough importance to financial patent and put themselves to a disadvantageous position in completion. Therefore, China’s commercial banks should establish and strengthen the awareness of financial patent, speed up the relevant research and set up the patent strategy to meet the challenge from the overseas counter parts.The article first introduce the basic concepts and categories of business method patent,mainly describe the impact of business method patents on financial institutions. With the rapid development of network technology, a large number of business method patents appeared .As the lack of experiences, China’s commercial banks couldn’t control the risk in electronic banking business.Through the analysis of the financial product patent of Citibank as well as our laws and regulations related to the BMP, comparing applications between foreign banks and domestic commercial banks, in order to find our faults. Thus propose our commercial banks to take the initiative activities and enhance awareness of the patent, so as to speed up and set establishment of a patent strategy.
