Abstract


Since the rise of retention of title system, the system of the contingent right became the hot spot of the German academic study. However, there is still no find conclusion about the basic points of the contingent right, such as the concept, the nature and so on. With the development of domestic economy, the law of the right protection in the real life tends to be detailed. Because of its particularity and economic value, the contingent right obtains the legal approval and protection. After the acceptance of the German theory of the contingent right, the civil law scholars has carried on the analysis and the discussion according to the legislative background of our country to this system , but it is still at the infancy stage. The related-research stays immature, without the overall theory system of the contingent right. This thesis takes the value of the contingent right system as the basic considerations, attempts to further clarify the elementary theory questions of the contingent right on the extant researches in order to research the essence of the contingent right deeply, and anticipates to return the contingent right to the rights of specific types, finally finds the right position in right system.
