1970’s,the USA scientist have re-organized success to human being DNA , genetic engineering and the biotechnology have had improving greatly, under this background , the inheritance gene which be contained in living things has appeared out lurking value step by step to human being. Our country is a biodiversity Great Power, which has rich biological resources, be containing pole utensil potential inheritance resource. It can hold out for urging hereditary resource to be that Chinese socialist modernization drive provides strategy better, so it is necessary to take the progress effective and manage to protect the inheriting resource. The article is according to arriving at peculiar writing from the sort, builds and perfects the structure of our country hereditary resource protection legal system.First, it starts with explanation the relevance concept inheriting resource protection legal system, and then ascertains the inheritance resource range on basis inheriting resource definition to the relevance in parallel international organization, the relevance country and our country.
