Abstract


With the global economic integration, as well as the rapid development of technology , e - commerce contract gradually replace the traditional contract to become the basis of international trade transactions and certificate . Suited to e-commerce development status of e-commerce contract as a new form of the contract , the contract common and showing the new features , making the existing adjustment contract legal norms . Therefore, the necessary supplement existing laws , and constantly improve the legal regulation of e-commerce contract . This paper consists of three parts . Overview of the first part of international e-commerce contract . Elaborated the concept of e-commerce contract , comparing e-commerce contracts with traditional contract relationship and difference , to analyze the characteristics of international e - commerce contract to make theoretical paving the way for the following discussion . The second part of the preliminary study of the core issues in the international e-commerce in the conclusion of the contract process . Both already in the traditional contract law issues , such as the formation of the contract time and place , offer and promise , but also new problems caused by this particular form because e-commerce , such as electronic signature , electronic agents , as well as online consumer interests protection . The third part of China's e-commerce contract legislation principles and specific recommendations for discussion before the international e - commerce contract , as well as the current situation of our system design , perfect . Examine the legislation of international e-commerce , draw two legislative model that is a single line of legislation and comprehensive legislation , a critical analysis of these two legislative model , and finally concluded - should learn from international viable legislative rules , the first based on the electronic business trends to amend existing laws and regulations , and then formulate a unified e-commerce Codex timely , as the overall guiding ideology regarding specific issues to do single-line legislation , so as to form a complete e-commerce law system .
