Abstract


Appeared in China in recent years many cases were related to the theory of anticipated probability, expected possibility theory is rooted in a liability in the civil law criminal law theory. Expected possibility judgment standard is the core issue of the theory of anticipated possibility, involving the cognizance of the crime and non crime problem, plays an key role in a correct sentence. Not expected possibility theory in the criminal law in our country, but it's criminal law has important significance for our research. Media attention xu malicious withdrawal cases will involve the question of whether its behavior is expected possibility, the judge's decision with ordinary people's expectation deviation happened, the weakness of human nature and the cold of the collision between the rule of law. This article from the perspective of the theory of anticipated probability in the case, and combined with several similar specific case analysis, and put forward the key issues in the theory of anticipated probability, namely the problem of the judgement standard of the last, the application of the theory of expected possibility question has carried on the exploration.
