Abstract


The M&A (Merger and Acquisition) is developing rapidly in China and around the world, whose positive influence and new features are obvious Not all the M&A will bring about monopolizing, but it is necessary to control the M&A activities by the antimonopoly law because this controlling is one of the methods to prevent monopolizing and protect the competitive order. On enterprises merger system is to make it s content and extension clear. By dialectical analysis of use and comparative analysis of relative theories in western countries, it can be clearly known that anti-monopoly law should seek the balance of moderate merger and anti monopoly.
