Abstract


China is a civil law countries . Seems essential in the process of building a modern nation ruled by law , a codification of the Civil Code' dissertation">Civil Code . Early years of the century , the domestic civil law scholars had on the Civil Code , a great debate , but most scholars relationship between civil law doctrine with civil law codification , as well as our civil law scholars well codification of the Civil Code of the full and preparation , lack of reflective thinking . Two representative countries of the civil law , which is also the history of the French and German civil law tells us , on the road leading to a successful civil code , civil law scholars must complete the the foreign doctrine successors , localization and systematic work in three areas .
