Abstract


Feeling of Civil Claims litigation by the status quo of obstacles author of historical background , combined with the Civil Claims and encounter legal obstacles to international criminal law as a support to the application of international humanitarian law , international criminal law , international law analysis , and other related knowledge to find the relevant legal basis for the Chinese civil Claims . In combination with the current conditions , the Civil Claims innovative ideas and suggestions . The paper broke through the limitations of previous jurisprudence to international law and civil law claim against Japan as a theoretical basis for thinking , international criminal law theory and practice of claim against Japan the combination of research , from the selection of subjects itself groundbreaking . Innovative interpretation of the properties and sources of the right to claim the rights to Japan , also elaborated on the criminal responsibility of States and other content to achieve some breakthrough . From a practical level , this paper focus on the real problem , combined with the historical background and the development status , in-depth analysis and rebuttal of the Japanese courts usually reasons for judgment , the removal of legal barriers to litigation towards Japan . Provide more legal basis and interpretation of multidimensional support litigation against Japan , the expansion of great practical significance to the further deepening of the ongoing claims practices and claims litigation .
