Abstract


Since February 2009, suddenly tense situation in the South China Sea, Southeast Asian countries have taken action to break the South China Sea has long been the calm. On February 17, the Philippine Congress passed the Baselines Act, our Huangyan Island and Nansha Islands reefs divided into Philippine territory; May 6th, Malaysia and Vietnam to the United Nations Commission on the Limits of the Continental Shelf jointly submitted their respective 200 nautical miles of the southern South China Sea continental shelf submission; May 7, Vietnam and submitted separately in some areas of the central part of the South China Sea outer continental shelf submission. 1 recent actions in the South China Sea countries is mainly due to the approaching deadline for the delimitation of the continental shelf. Study the fundamental reason, however, is attracted to the rich oil and gas resources in the South China Sea. In addition to the South China Sea with excellent location, rich in mineral resources such as oil, natural gas, called the \In today's world oil reserves has become an important indicator to measure a country, can contribute to the economic growth of the country has oil and gas resources, to improve the socio-economic situation, to enhance a country's comprehensive national strength, States have the strategic objectives set at further oil and gas exploration development. However, the South China Sea because of the special geographic, historical, legal and other reasons, led to the existence of countries each party situation, the resources have not been fully developed to utilize, so research the legal issues have practical and theoretical significance of the exploration and development of oil and gas fields in the South China Sea. Combined with text analysis of the theory and practice of international law on the legal issues of the development of oil and gas fields in the South China Sea, the main body is divided into five parts: The first part describes the present situation of the South China Sea oil and gas exploration cited as title, Malaysia, Indonesia, Brunei, Vietnam, the Philippines cited and China on the development of oil and gas fields in the South China Sea. The second part includes detailed descriptions of the legal basis for the development of oil and gas fields in the South China Sea, the regime of the continental shelf, the coastal State in the continental shelf sovereign rights set forth an overview of the relationship between the continental shelf and the exclusive economic zone, and illustrates the basic principles of the delimitation of the continental shelf - fair principle, the delimitation of the continental shelf and the joint development of the relationship. The third part focuses on the South China Sea oil and gas field development and co-development system, a variety of solutions for the exploration and development of oil and gas resources in the South China Sea, jointly developed by analyzing the most practical, combined with the current situation in the South China Sea is more suitable for this type of co-development of overlapping maritime; explore the joint development of the legal characteristics of the legal status, comprehensive analysis of the impact of oil and gas fields in the South China Sea to jointly develop factors from four aspects of the political, economic, legal and social culture, in order to facilitate the smooth development of common development. The fourth part of international practice begin from the ocean to jointly develop oil and gas fields, again demonstrate the necessity and feasibility of jointly developed by three specific cases. Successful international practice to conduct joint development in the South China Sea to provide the most valuable reference text. Part V summarizes the program of the neighboring countries in the South China Sea to the South China Sea issue, finishing the development progress of the neighboring countries in the South China Sea in recent years, such as the negotiation process in the Philippines, and Vietnam, Indonesia, summed up: joint development of oil and gas resources in the South China Sea through a comparative analysis should resolve the problem, the Joint Development Zone, select, joint development of the main, to jointly develop the project. Oil and gas fields in the South China Sea to jointly develop a long way to go, requires the joint efforts of the Parties in the South China Sea.
