Abstract


There is no denying that RMB cross-border settlement has become a social topic as well as a widespread new phenomenon which gives rise to a heated debate. The debate should be interpreted neither as superficial nor as artificial, but is rooted in the increasingly rapid development in the contemporary society.With the ecnomic development, RMB is becoming an international currency and China has started the pilot program of RMB settlement in cross-border trade. Perhaps the most significant development was a RMB trade settlement pilot scheme that came into operation 2007,July. Five coastal cities in China will participate in a pilot project allowing the use of RMB to settle cross-border trade payments. We will promote pilot projects for the use of the RMB in cross-border trade , and gradually develop overseas nancial activities using the RMB.Though RMB use in more and more region , in our nation has no legal safeguard about how to make the more safe economic environment in order to ensure the progress of RMB cross-border settlement.The thesis has four parts,it include the concept and the theory of RMB cross-border settlement, the international law of RMB cross-border settlement and the successful experience, the legal safeguard problem in China’s RMB cross-border settlement progress, and the last part is how to resolve the legal safeguard problem ,and give some proposals on the legal safeguard of RMB cross-border settlement.Restrictions on offshore transfers have been eased and a programme allowing companies to settle cross-border trades in RMB expanded. It is a good initiate for China’s economic development and reform and open up.So we must give the same good initiate for RMB with it’s cross-border settlement on financial law and legal safeguard.
