Abstract


The perpetrator made use of the network as instruments of crime , wantonly engaged in obscene electronic information (hereinafter referred to as \Punish obscenity crime the main problem is how to accurately identify the meaning of obscenity and obscenity crimes, so as to clarify the difference between crime or this crime and other crimes . Study obscene information incriminated problem should first grasp the concept of obscenity in nature , and then analyze the characteristics , which summed up the concept as well as the characteristics of obscenity crimes . Second , in accordance with the provisions of the existing criminal law and judicial interpretation , the elements of the crime that the crime involved around the obscenity analysis identified specific identified can be classified into two broad areas : first, production, reproduction , sale , publication, dissemination of pornographic materials the Crime mainly covers the subject of crime , criminal behavior and the subjective aspect of crime ; the Crime of other pornographic materials , mainly covers others provides book publishing pornographic books and crime , the crime of dissemination of pornographic material , pornographic performances criminal organizations play pornographic audio-visual products of crime and organizations Identification . According to the above identified a relatively clear understanding of obscene connotations , and better able to grasp the relationship and the difference between the sin and the sin , combined with the Criminal Code , the judicial interpretation will favor auxiliary judicial practice .
