Abstract


Robbery serious social harm citizens' property rights and personal rights , and frequent crime . After the 1997 Criminal Law Amendment , they put a house robbery robbery set to statutory one of the aggravating circumstances . New problems emerging in real life , the understanding and application of legal practitioners to the corresponding provisions of the Criminal Code does not form a unified standard , caused by the inconsistent application of the law , resulting in the conviction and sentencing of imbalance , prejudice the interests of justice . In this regard the Supreme People's Court released the Opinions on Several Issues of Specific Application of Laws on the trial of the robbery explain \Burglary further explained the concept .
