Abstract


This thesis focuses on the public reliance from real estate registration, which is an important system in real estate law. As China’s economy development, especially the unprecedented prosperity of real estate market, which people expect and require are more safety and efficiency during the real estate transactions. The trust on the ownership contents of the real estate registries is an important basis for fair trade; for the protection of this trust, the public reliance from real estate registration is essential to the whole property legal system, and it also depends on the protection from the property registration systems.Although in the protection of real estate transaction security, China’s Property Law has a great improvement then the laws and regulations in the past, but it evaded the public reliance from real estate registration and leads to the security risk of real estate transactions. Therefore this thesis discussed the building of public reliance from real estate registration in china.The structure of this thesis, apart from the preface and the ending, is as follows:The first chapter is the basic introduction to public reliance from real estate registration, includes the concept, the legal value and application conditions public reliance from real estate registration.In the perspective of comparative law, the second chapter introduced public reliance from real estate registration and its rely-on systems in foreign countries. Many civil law countries and regions, such as Germany, Switzerland, Japan, South Korea etc., some the public reliance from real estate registration, some established public reliance from real estate registration in legislation, some apply the public reliance from real estate registration by interpreting the judicial precedent. In addition, these countries also ensure the correction of the content recorded on the registries by perfect registration procedure. The research of foreign advanced experience provides knowledge to build China’s public reliance from real estate registration.Chapter III reorganized Chinese present legislations about public reliance from real estate registration, highlighted the legislative attitude to public reliance from real estate registration and the disadvantages of present registration system, in order to provide superficial suggestions to future legislation.
