Abstract


The property services disputes in recent years presents a rising trend , the owners' committee also often involved . Point of view but from the current legislative framework , the legal status of the owners' committee has always be a unsolved problems . Property Law , Property Management Regulations \Judicial practice and theoretical circles for the problem is not of uniform standards and perspectives . Thus , the legal status of the owners' committee to be in-depth study and perfect their legal status , and responsibility is essential . In this paper, the specific case as a starting point , a detailed analysis of the knowledge related to the owners 'committee : the owners and property owners eligible for use of the property , the owners' representative , the voting rights of the owners and property service enterprise , dialysis there . The basis of existing research results combined with the current situation of the owners' meeting and the owners' committee , theorists and judicial practice on this issue as well as the existing legislative framework , the legislation outside the civil subject qualification of the owners' committee and litigation subject qualification Expand path , discussed the issue , that should be given the status of the owners' committee unincorporated organization . Clear the legal status of the owners' committee and responsibility from internal and external perspectives .
