Abstract

With the further development of the video-sharing sites, there are more and more disputes about its copyright infringement. The obligee have accessed to the courts to protect their interests, however, because of the ambiguous law in China, similar cases in different courts had different results, which not only infringes the interests of the owners, but also greatly damages the authority of the law. Furthermore, this situation has hindered the healthy development of our culture. So this article starts with a typical Copyright Infringement Case which was between Beijing Sohu and Shanghai Tudou. this article tries to find the standards of such cases by analysing the focus on disputes of the two relevant judgments, and combining with some correlative regulations such as the guidance released by Beijing higher people’s court and the "Digital Millennium Copyright Act" of the USA. And the last part of this article advances some suggestions to improve the develop mode of video-sharing sites through three aspects which are legislative, administrative and the video-sharing sites itself, in order to enhance the expand of the video-sharing sites industry.
