Abstract


Food safety is a major issues related to social development. In recent years, an endless stream of food safety accidents, damage to the physical and mental health of the consumer, social panic increasing food security, the importance of food safety issues continue to emerge. The social situation, there are many reasons; from a juridical point of view, China's food safety regulatory legislation system is imperfect, the regulatory system is not perfect is an important reason. Our government is aware of the problem, and start a food safety regulatory reform. However, our current food safety regulatory model is not mature, there is no accurate way of thinking and positioning on many issues. Therefore, on the basis of clearly defined concept of food safety, food safety regulatory analysis of the characteristics of our legislative system of food safety regulation and the problems, and also examines the United States, Japan and other developed countries, food safety legislation, and perfect China's food safety regulatory legal system has made several suggestions, hoping to play a valuable role. This article is divided into a total of four parts: The first chapter discusses the basic concepts of food safety regulation, including the concept of food security, the concept of food safety supervision and the need to discuss the various factors affecting food safety and expand further behind the discourse lay a foundation; food safety legislation in the case of the United States, Japan, the European Union, the United Kingdom and other developed countries and regions examined in Chapter II, analyze the pros and cons of the legislative system characteristics and regulatory mechanisms, the characteristics of each country system of research for China's food safety legislation and learn; Chapter of China's food safety regulatory status of legislation, a review of the emergence and development of the legal system of China's food safety supervision, and pointed out that the problem of the current legislation food safety standards lag as well as the legal liability system is imperfect, and its roots from a legal point of view. Chapter IV for the lack of the legal system of China's food safety regulatory Solutions, established the basic scientific principles of law, that the principles of risk assessment, the precautionary principle, the principle of the whole process of supervision, food safety responsibility principle, and the principle of information disclosure. Further improve food safety standards, improve the legal liability system and food market access system, and to the continuous improvement of the existing legal system of food safety regulation.
