Abstract


This paper as a legal history master thesis, the core is revealed " residence and wealth sharing " in traditional Chinese law, namely researching through the connotation of Official precedent, case to the concept as a legal perspective, describing the rheological process by the interpretation with historical perspective, and evaluating it in present significance. The Chinese legal system has the obvious family doctrine of color, and " residence and wealth sharing " can say that in which the central role played, because it on the one hand manifests intense ethical color, on the other hand, from the economic aspect guarantee the stability of the family system, so this system is the interpretation of "family" for the term legal interpretation. Categories such as " XingAn-Hui-Lan(Conspectus of Penal Cases) ", "BoAn-Hui-Bian(Boan congbian) " in such books collection of records a lot of official convicted dating, a true reflection of the" residence and wealth sharing" in the daily life, therefore, through which we can clearly see their families method brightly-coloured in dealing with the Chinese legal system is how to operate family cases," residence and wealth sharing "by law system is how to strengthen our traditions of family relationships, how was arranged, ancient Chinese legal exactly is how to lose energy, but modern westernized way how their quick, and through this process we can also get realistic enlightenment, correctly treat our current gain and loss, of the road of the rule of law to rediscover themselves in the future.
