Abstract


Autonomous local legislative powers under the law in ethnic autonomous areas in China a special power in the autonomous areas for better implementation of national laws and the promotion of autonomous local political, economic and cultural development, has an important role. This report is based "The People’s Republic of China Constitution," "The People’s Republic of China Legislative Law," "The People’s Republic of China on Regional Ethnic Autonomy," and other related laws to ethnic autonomous areas to study legislative perspective on the legislative power of the ethnic autonomous areas Theory and practice of sorting out the system and clear exposition, and its legislative proposals. In this paper, the structure is divided into four chapters:The first chapter from the nature of legislative power from the autonomous areas and composition of both the elaboration and analysis of their conduct. Specific, this chapter from the right and power of, local and national autonomy to the nature of its analysis of the three, and from the legislative and other powers associated with comparison of ethnic autonomous areas to further deconstruction of legislative power.The second chapter legislative power from the ethnic autonomous areas to set the theoretical foundation and legal basis for the legislative power of ethnic autonomous areas to further elaborate. Concrete, one dollar and the yuan from the legal equality and justice theory and analysis of autonomous local legislative power theoretically established the theoretical basis and in accordance with "The People’s Republic of China Constitution," "The People’s Republic of China Legislative Law," "The People’s Republic of China on Regional National Autonomy Law "and other laws to explain the legal basis for autonomous local legislative powers.The third chapter of the national autonomous areas were summarized in one stage of legislative power and its exercise in the current analysis of the issues encountered. This chapter three phases of the ethnic autonomous areas the practice of legislative brief summary and comment on the exercise of legislative power to the ethnic autonomous areas the specific problems encountered in the analysis.Chapter IV of the national local legislative power in the exercise of the problems encountered in practical suggestions. In the third chapter of this chapter, based on legislative power for the current problems in ethnic autonomous areas many aspects of contemporary China from the autonomous areas of sound legislative proposals and put forward specific measures.
