Abstract


Since 2000 , China's sustained and rapid economic growth while maintaining the overall stability of production safety , the development trend of getting better , but the current production safety situation is still grim, total accidents is still very great , coal and other key industries of major accidents multiple momentum has not been effectively curbed , the need for comprehensive measures to comprehensive treatment . In China 's industrial injury insurance system has been established and in the coal , construction , transportation and other industries to implement accident insurance mechanism so a useful attempt. However, these insurance mechanisms focused primarily on ex post compensation for personal injury or death , do not fully reflect the safety principle of prevention , although the producers played Accident Compensation of employees role, but neglected to prevent and resolve safety of employees by enterprises risk of legal liability . In our system of production safety , liability insurance absence of the phenomenon are still quite prominent . Domestic and international experience and domestic realities are that play an active role in liability insurance , help prevent and resolve social conflicts , reduce the government bailout after the accident burden , and promote transformation of government functions . Study the establishment of close interaction with the management of production safety liability insurance mechanism, vigorously promote the development of liability insurance for the effective integration and security , liability insurance full use of economic instruments to strengthen and improve safety conditions .
