Abstract


Overseas Chinese have been to China and the fight for independence and liberation of the Chinese nation , safeguard national unity and territorial integrity , and political , economic and cultural construction depends important and indispensable power . Regardless of their nationality , the overseas Chinese is still part of the Chinese nation . However, the history of overseas Chinese suffered persecution and discrimination in the country , until today , there is no end. To protect the legitimate rights and interests of overseas Chinese , the Chinese government is duty-bound . If it is said that the national force is the external protection of law enforcement , then the existence of the legal responsibility and accountability is legal \Since the end of World War II , the international legal system has been developed out of the legal means to pursue another State the responsibility of the offense (including international crimes ) can be used as a country , is this one of the means of diplomatic protection systems . So , whether it is for the protection of the legitimate national interests of overseas Chinese , or out to fulfill the maintenance of international peace and security in the world political responsibility , the Chinese have reason to use . Thus, the to explore diplomatic protection system will have a practical significance . For this purpose , I proceed from the reality of international law on diplomatic protection system exists in the form of analysis , the empirical analysis on the basis of international law , as well as with other relevant international law mechanisms , further argues that China can use diplomatic protection system to protect the legitimate rights and interests of overseas Chinese .
