Abstract


Inland shipping is an important part of comprehensive transportation system. EU’s inland shipping economy which is in the leading position in the world, the proud benefits it achieved is closely related to its advanced management policies and legal regime. Shipping safety management law which in order to provide protection and support to shipping economic law is an important part of the shipping economic law. The thesis aims at studying the EU laws and policies on inland shipping safety management, thus, drawing up lessons and enlightenments to our country to improve our inland shipping safety management system and policies, thus stimulate the further development of inland water transport economy. This thesis comprises three parts:The first part describes the basic theory of the shipping safety management law. This part will make theoretical analysis from the legal definition, nature and its status and influences in the shipping economic law,in order to draw up the principles of making shipping safety management law.The second part studies inland shipping safety supervision law and related policies since the 20th century 90s of EU. This article will from the objects of inland waterway transport safety management perspective, separates the EU inland water transport safety management laws and policies into the vessel, crew, shipping companies, infrastructure aspects. For ships, it mainly introduced relevant directives, regulations and policies on the unified technical standards of ships of the EU and EU member states (the Netherlands and Germany), and safety management of ships carrying dangerous goods. For the crew, the commands on the minimum standards of unifing river crew qualification are specifically introduced. In the shipping companies part, it briefly introduced related regulatory laws and policy measures about security system and technical requirements as shipping companies market access conditions to improve the level of safety management. In the inland shipping infrastructure part, relevant plans, policies and the action platforms for port and waterway construction and maintenance were introduced.In the third part, through the introduction of existing development of our inland waterway shipping and related legal regimes and policies of safety management. The shortage of our inland waterway shipping safety management was pointed out.Problems of our inland waterway shipping safety management lied on the unreasonable hierarchy of the legal system and the low force of law issues. Via introducing the settings and features of the inland waterway transport safety management subjects, the conclusion was out of there that the structural and idea problems is one of direct affecting matters to the level of inland waterway shipping safety management. Through specific analysis about the existing situations and lack points of the legal regimes and policies on the ship, crew, shipping companies and infrastructure, according to our actual situations and learn the essence behind the success of the European Union, proposed to increase the legislative level, set up the river crew legal system integrated with the international legal system and improve the river crew management system, improve the regulations on the inland shipping market access, and gradually improve the shipping infrastructure construction and security management regulations to enhance information degrees, in order to provide a valuable reference.
