Abstract


Since reform and open, Chinese have begun the reform of exploiting-system of state-ownership land, changing the traditional system from free of charge, no deadline, no flow into compensable, deadline and flow. Land lease appeared and became the way of government supplying land. Land lease played a very big positive role to our country socio-economic development, particularly urban construction. It promoted the advancement of our country’s urbanization and industrialization.Now, Chinese have been in the social transformation period. Along with the fast development of social economy, socialist market economic system has been developing, adjusting and consummating unceasingly. The reforming about government system also has been deepening unceasingly. With this kind of reforming macroscopic system environment and current economic condition, local government’s behavior may be separated from policy and law’s limit and deviated from public administration’s goal during the process of land lease, because lacking effective surveillance and restraint mechanism. The phenomenon of land illegal was common. It not only has brought the adverse effect for urban construction, created a huge outflow of urban economy, social and environment’s benefit, but also has not been favorable for our economy’s steady progression and the establishment of harmonious socialist society and the socialist rule of law. Therefore, the research on local government’s behavior in the system of land lease has important theoretical and practical significance.This essay seeks a layout according to "pose question, analyze question and solve question". It embarks from the present situation of our country’s land lease system, poses the question of the anomie of local government’s behavior in the system of land lease, analyzes the performance, reason and consequence of the anomie of local government’s behavior, and at last reshapes local government’s behavior from different level. It has five parts concretely. Fist part, introduction. Introduce the essay’s research background, significance, related question’s present situation, research mentality and techniques. Second part, the basic category of land lease and major related theories. Summarize land lease’s meaning, characteristic, category and way and trace the land rent theory from history. The third part, local government and land lease. Analyze our country land lease system’s development condition, its function to local socio-economic development and local government’s responsibility, jurisdiction and procedure in the system of land lease. The fourth part, the anomie of local government’s behavior and its reason and consequence in the system of land lease at present. Pose the question of the anomie of local government’s behavior in the system of land lease and analyze the performance, reason and consequence of the anomie of behavior from multiple perspectives. The last part, reshape local government’s behavior standard in the system of land lease. Take the reform of local government administrative system and exploiting-system of land as a foothold and make some suggestions to standard local government’s behavior from five levels that transforming idea, consummating system, innovating policy, standardizing behavior and optimizing environment.
