Abstract


Finaneial Derivatives is the high-teeh Produets fromg lobal finaneial Innovation tide wave during the 1970’s and 1980’s. It’s an new sort of finaneial tool derivate upon traditional finaneial Produets, sueh as currency, stock, bondete.Financial derivative has great risk eaused by its leveraged, future and dummy characteristics,so it can improve or damage the economy. Although the financial derivatives was not a direct incentive to the financial turmoil,but it had played a role in adding fuel to the flames. So This paper which considers the sub-loan crisis in the United States as an opportunity, attempts to do some beneficial exploration on legal supervision of finaneial derivatives.Base on that,this paper introduces the concept,types and characteristies of finanial derivatives,and then point out the serious defieieneies of legal supervision of finaneial derivatives is an important reason for the outbreak of the U.S.sub-loan crisis. After that this paper reviews the development course of China’s financial derivatives, introduces China’s the status quo of legal supervision of financial derivatives, and points out the issues that are existing in China’s legal supervision of financial derivatives.Then this paper pionts out the lessons that the U.S.sub-loan crisis has given us in legal supervision of financial derivatives.Based on our actual financial supervision, in the last Part, the paper gives some suggestions for the improvement of China’s supervision laws of finaneial derivatives.
