Abstract


With the diversification of social subjects on the values ??and cultural traditions and conflicts of interest in contemporary the diversified disputes resolution mechanisms has become a worldwide issue . States usually a variety of non-litigation dispute resolution outside the court are collectively referred to as alternative dispute resolution way ( ADR ) . Mediation as a major form of ADR and trial together constitute the two main dispute settlement mechanism in China . However, in recent years , with the active development of the market economy , the mediation system is also exposed many shortcomings. Western countries such as the United Kingdom , Canada , Australia , the mediation system development more mature , extremely important reference for our country . China 's legal and cultural traditions and mediation trends , a scientific to absorb reasonable factors other national mediation system , and on this basis , the formation of a mediation system with Chinese characteristics . The text is divided into three chapters : the first chapter briefly Commonwealth countries in the United Kingdom , Canada and Australia , three countries mediation system . Chapter II mediation system from three aspects of these three countries are compared . Chapter III made ??a brief overview of the history of the development of the mediation system in China , and the problem that exists today , focuses on mediation system of the Commonwealth countries on China 's revelation .
