Abstract


The development of the telecommunications industry in the developed countries in the world is bounded roughly 1980 to 1980 before the national telecommunications industry generally taken a monopoly operation , called the introduction of pre-competitive stage ; led after 1980 , the developed countries have introduced competition to establish competitive control mode , called the introduction of competition stage . Control of practice change in close contact with the development of the control theory . The control theory essentially is a natural monopoly and economies of scale is to safeguard the public utility monopoly advantage , so the initial control and regulate their prices . Inferior and economies of scope change people 's view of natural monopolies , in addition to infrastructure and basic business telecommunications business can introduce competition in order to better development . The telecommunications industry , including public utilities laws began to change control methods , the introduction of competition . The asymmetric regulation legal system is essential for the telecommunications industry, the introduction of competition . Balanced philosophy and social standard of the competition law concept of asymmetric regulation has a certain impact . The development of telecommunications technology provides the possibility for the telecommunications competition , but the dominant carriers are bound to safeguard their vested monopoly interests to use its market power to new entrants in no way operating period of the telecommunications business . The contradiction between the small competitive dynamics and competition resistance to the reasons for the introduction of asymmetric regulation . Asymmetric regulation in the legal system , the most important thing is the object of its regulation of the screening , the world 's greatest impact on the EU 's SMP assessment system . A prerequisite for establishing the asymmetric regulation is the first to be the relevant market and to compete effectively judge to decide whether an enterprise is the dominant carrier , then take concrete asymmetric control measures . By dominant carriers to adopt restrictive measures to restrict market forces may affect new entrants in the competition to create a fair competition environment to nurture and maintain the telecommunications market . The asymmetric control legislation explicitly introduced in view of China's telecommunications industry is in a stage of the introduction of competition to develop the market , no doubt is the trend.
