Abstract


China since 2003 began a pilot community corrections work , community correction theory and practice have achieved preliminary results and accumulated some experience. However, China's community correction judicial and administrative work , there are still some problems and defects, such as community corrections nature of the judicial administrative powers , attribution is not clear, the main body of the administration of justice community corrections multiplex . The existence of these problems and defects affecting the effectiveness of Community Correction rehabilitation of offenders , community corrections hinder our development process . To solve these problems must carefully analyze community corrections nature of the right administration of justice , community corrections explicitly vested right to the administration of justice . It should be combined with China 's traditional in reforming criminals experience , to further clarify the judicial community corrections executive powers and duties and the rights and obligations of Correctional Officers , and learn from foreign community corrections legislation, the status of the body such as the useful experience and authority to resolve judicial and administrative bodies responsible for the administration of justice community corrections difficulties faced to make the administration of justice, community corrections countermeasures more complete.
